Webinar Terms And Conditions

These terms and conditions (“Terms”) applies to Webinars (“Webinars”) and any recordings, documents, information or opinions obtained from or ancillary to the Webinars. These Webinars have been issued by Kalkine Pty Limited (ABN 34 154 808 312) (Australian financial services licence number 425376) (“Kalkine”) and prepared by Kalkine and its related bodies corporate. You are advised to read these Terms carefully before registering, accessing or participating in the Webinar. If you disagree with anything, do not register or attend the Webinar.

To be eligible to participate, you must be 18 years old or older.

Registering for a Webinar only constitutes an agreement to attend the Webinar. Registration and viewing the event does not give anyone ownership of the content.

By registering, accessing or participating in a Kalkine Webinar, you agree and acknowledge that: (1) The information contained in the Webinar and related materials (a) are provided to you for general information only and should not be used or relied on as a recommendation/advice or basis for making any specific investment, business or commercial decision; (b) does not constitute an offer or solicitation to buy or sell any security or instrument, or an invitation or a recommendation to enter into any transaction; (2) All financial market products contain risks and may not be suitable for everyone, you should consult with a lawyer, tax advisor, financial adviser or other professional adviser to determine what may be best for your individual needs; (3) The views expressed by guest speaker (“Speaker”) in the Webinar are their own and not, necessarily, of Kalkine. Their appearance on the Webinar does not imply any endorsement of them or any entity they represent; (4) Kalkine makes no representation, warranty or guarantee express or implied as to, and shall not be responsible for, the accuracy or completeness of the information contained in the Webinar (presented by Kalkine or Speaker) and related materials. Neither Kalkine nor any of its affiliates (including its shareholders and their related corporations) and their respective directors, employees, officers and representatives shall be liable in any manner whatsoever for any consequences (including but not limited to any direct, indirect or consequential losses, loss of profits and damages) of any reliance thereon; (5) You shall indemnify, defend and hold harmless Kalkine and its directors, employees, officers and representatives from any and all third party claims, liability, damages or costs (including and not limited to legal fees) arising directly or indirectly in connection with the Webinar; (6) All right, title, and interest (including all copyrights and other intellectual property rights) in the Webinar and related material is owned by Kalkine and/or its affiliates except as stated otherwise; (7) Kalkine is not liable for the detailed content of any Webinars, quality of presentation or if learning outcomes did not entirely meet expectations; and (8) Any company or investment mentioned in the Webinar is purely used to illustrate an example for educational purposes only, and does not represent a recommendation or advice by Kalkine for you to invest in this financial product.

The Webinar may include links to other resources or websites. These links are provided for your convenience only and do not signify that Kalkine endorses, approves, or makes any representation or claim regarding the accuracy, copyright compliance, legality, or any other aspects of, the resource(s) or website(s). You are advised not to send any confidential or sensitive information to Kalkine in the context of a Webinar.

Kalkine expects ALL people who register and attend Webinars to be courteous to all others in attendance. Hateful, racist and sexist comments will not be tolerated, and hostile or violent remarks (written or verbal) directed to other people (attending the event or not) also will not be tolerated. Kalkine reserves the right to remove and/or ban anyone from the Webinar for any reason.

The on-line provision and recording of Webinars by Kalkine are supported by the software application Zoom. All parties registering and accessing a Webinar agree that they do so subject to the terms and conditions of this software application.

Participants will not make audio or visual recordings of the Webinar in any medium—and will not distribute audio or visual recordings of the Webinar (via social media or any other means). Only Kalkine or its representatives may do so.

By registering and logging onto a Webinar, you agree to the following:

Your personally identifiable information may be collected/captured or used by Kalkine as the organiser for marketing purpose and you consent to be contacted by email or phone as set out in our Privacy Policy.
Any communication or information transmitted during the Webinar, such as live instant messaging displaying names of those intervening, and presentations, are recorded and shall be used by Kalkine for further promotion and information purposes.
Kalkine may further use the information available on the Webinar such as invitees lists, attendee logs, information on the Webinar subject matter and recordings thereof.
If you do have to sit this Webinar out for any reason, you will receive a recording of the event for personal and non-commercial use. Webinar registration fees are non-refundable. If for any reason Kalkine needs to cancel a Webinar, a notification email will be sent as soon as possible and Kalkine may elect to offer transfer of registration to another Webinar.

These Terms are governed by and construed in accordance with the law for the time being in force in New South Wales and you, by agreeing to these Terms, are deemed to have submitted to the exclusive jurisdiction of the courts of New South Wales and courts of appeal from those courts.

Kalkine reserves the right to amend the Terms of the Webinar at any time without notification unless substantial amendments are made.
